Terms of Service

By creating an account or using OpsHub, you confirm that you are at least 16 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms and our Privacy Policy. If you are using OpsHub on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

OpsHub is a multi-tenant business operations platform that provides CRM, task management, team communication, attendance tracking, forms, project management, and related tools ("the Service"). We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

To use OpsHub, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

Each organisation is assigned a unique org code. You are responsible for ensuring that only authorised individuals use your org code to access your workspace.

OpsHub offers subscription plans (Starter, Team, Growth, Scale) as described on our pricing page. By selecting a paid plan, you agree to pay the applicable fees.

• Billing — subscriptions are billed monthly or annually in advance.
• Automatic renewal — subscriptions automatically renew unless cancelled before the renewal date.
• Price changes — we will provide at least 30 days' notice before changing subscription prices.
• Refunds — we offer a 14-day money-back guarantee for new subscriptions. After 14 days, payments are non-refundable except as required by law.
• Taxes — prices are exclusive of applicable taxes, which will be added at checkout.

You agree not to use OpsHub to:

• Violate any applicable laws or regulations.
• Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorised access to any part of the platform or other users' accounts.
• Use the platform to send unsolicited commercial communications (spam).
• Scrape, crawl, or use automated means to access the platform without our express written permission.
• Interfere with or disrupt the integrity or performance of the platform.
• Engage in any activity that could damage, disable, or impair the platform.

The OpsHub platform, including its design, code, trademarks, logos, and content created by us, is owned by OpsHub and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for your internal business purposes.

You retain ownership of all content you create or upload to OpsHub ("User Content"). By uploading User Content, you grant OpsHub a worldwide, royalty-free licence to host, store, and display that content solely for the purpose of providing the Service to you.

Your use of OpsHub is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process your data in accordance with our Privacy Policy and applicable data protection laws.

OpsHub operates as a multi-tenant platform. Each organisation's data is logically separated from other organisations. We implement technical and organisational measures to prevent unauthorised access to your data by other tenants. However, all tenants share the same underlying infrastructure.

We strive to maintain high availability of the platform but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for any losses arising from platform downtime, outages, or service interruptions.

Either party may terminate the agreement at any time. You may cancel your account through the platform settings. We may suspend or terminate your account immediately if you violate these Terms or engage in conduct that we reasonably believe is harmful to OpsHub, other users, or third parties.

Upon termination, your right to access the platform ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless required by law.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FULCRUMBIZOPS (PTY) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FULCRUMBIZOPS (PTY) LTD IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless FulcrumBizOps (Pty) Ltd and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the platform, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Sandton, Gauteng, South Africa, in accordance with the Arbitration Foundation of Southern Africa (AFSA) rules.

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or through the platform. Your continued use of OpsHub after the effective date of changes constitutes your acceptance of the updated Terms.

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and OpsHub regarding the use of the platform and supersede all prior agreements and understandings.
